1. About Lexur

Lexur is a business-to-business (B2B) platform that allows registered trade customers to browse hardware and electrical products, place orders, track deliveries, view invoices, and manage commercial terms such as credit limits and offers.

Lexur is operated by Matariya Industries, a manufacturer and supplier of hardware and electrical products based in Surat, Gujarat, India.

2. Eligibility

The App is intended for authorised business users only, such as retailers, distributors, contractors, and other trade customers.

• You must be at least 18 years old and legally able to enter into binding contracts.
• You must provide accurate business and identity information during registration and onboarding.
• You must have authority to act on behalf of the business you register.
• We may approve, reject, suspend, or terminate accounts at our discretion.

3. Account registration and security

• Access is provided through OTP-based login linked to your registered mobile number.
• You are responsible for keeping your device and login credentials secure.
• You must notify us promptly of any unauthorised access or suspected misuse of your account.
• You are responsible for all activity conducted through your account unless you report unauthorised use without delay.
• We may require GST, PAN, Aadhaar, or other verification details to activate or maintain your account.

4. Orders, pricing, and availability

• Product listings, prices, discounts, stock availability, and delivery timelines shown in the App are subject to change without prior notice.
• An order placed through the App is an offer to purchase. We may accept, reject, partially fulfil, or cancel an order before dispatch.
• Prices may differ based on your approved business terms, offers, quantity, transport route, or other commercial settings linked to your account.
• We try to display accurate product information, but we do not guarantee that descriptions, images, specifications, or pricing are error-free.
• We may correct pricing or product errors and cancel affected orders, with reasonable notice where possible.

5. Payment and credit terms

• Payment methods, credit limits, due dates, and other commercial terms are set by Lexur based on your approved account profile.
• Some payments may be completed outside the App through UPI or other payment apps you choose to use. Lexur does not store your full bank or UPI credentials.
• You agree to pay all amounts due within the agreed credit period and according to invoices issued for your orders.
• Failure to pay on time may result in suspension of ordering privileges, recovery action, interest or charges where permitted by law, and withholding of further dispatches.
• Offer payments, advance payments, or promotional schemes may have additional conditions shown at the time of acceptance.

6. Delivery, transport, and risk

• Delivery is arranged through the transport provider and branch selected or approved for your order.
• Estimated delivery dates are indicative only and may vary due to logistics, stock, weather, or other factors outside our control.
• You are responsible for providing accurate delivery details and for receiving goods at the agreed destination.
• Risk in goods generally passes to you upon dispatch from our premises or handover to the selected transporter, unless otherwise agreed in writing.

7. Returns, defects, and cancellations

• Return, replacement, or cancellation policies depend on product type, order status, and applicable commercial terms.
• You must inspect goods on receipt and report visible damage, shortage, or defects within a reasonable time.
• We may refuse returns for goods that are used, altered, or not in resalable condition unless required by applicable law.
• Order cancellations before dispatch may be accepted at our discretion. Once dispatched, cancellation may not be possible.

8. Offers, promotions, and discounts

Offers shown in the App may require payment, acceptance of specific conditions, or fulfilment of minimum order criteria. We may modify, suspend, or withdraw offers at any time. Misuse of offers or fraudulent activity may result in cancellation of benefits and account action.

9. Acceptable use

You agree not to:

• Use the App for unlawful, fraudulent, or unauthorised purposes
• Provide false, misleading, or incomplete business or identity information
• Attempt to access accounts, data, or systems you are not authorised to use
• Interfere with the App’s security, performance, or normal operation
• Copy, scrape, reverse engineer, or misuse App content except as permitted by law
• Resell or redistribute App access except as part of your authorised business operations

10. Intellectual property

The App, its design, software, logos, product content, and related materials are owned by Lexur or its licensors and are protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable licence to use the App for your authorised business purposes while your account remains active.

11. App permissions and third-party services

The App may request permissions such as internet access, notifications, camera, or storage to provide its features. Some features rely on third-party services such as OTP providers, cloud hosting, Firebase push notifications, GST verification services, and external payment apps. Your use of those services may also be subject to their own terms and policies.

12. Suspension, termination, and account deletion

We may suspend or terminate your access to the App, with or without notice, if you breach these Terms, misuse the App, fail to pay amounts due, provide false information, or if continued access is not commercially or legally appropriate. You may stop using the App at any time.

You may delete your account from Profile → Edit Profile → Delete Account in the App. Deletion requires OTP verification and is permanent once confirmed; it may proceed regardless of order or payment status. Personal profile details are removed from active use, but order and invoice records may be retained where required by law. Contact support if you need invoice copies after deletion. Termination or deletion does not affect accrued payment obligations or rights that by nature should survive termination.

13. Disclaimers

The App and its content are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or free from security vulnerabilities. Product suitability for a particular purpose remains your responsibility as a trade buyer.

14. Limitation of liability

To the maximum extent permitted by applicable law, Lexur and its directors, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, business, data, or goodwill arising from your use of the App or purchase of goods, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim relating to the App or these Terms shall not exceed the amount you paid to Lexur for the specific order giving rise to the claim during the three (3) months before the event, or INR 5,000, whichever is greater, except where liability cannot be limited under applicable law.

15. Indemnity

You agree to indemnify and hold harmless Lexur from claims, losses, liabilities, and expenses arising from your misuse of the App, breach of these Terms, violation of law, or inaccurate information provided by you or your business.

16. Governing law and disputes

These Terms are governed by the laws of India. Subject to applicable consumer or trade protection laws, courts at Surat, Gujarat shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or your use of the App, unless otherwise required by mandatory law.

17. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Continued use of the App after an update means you accept the revised Terms. If you do not agree to updated Terms, you must stop using the App.
